    The use of the 'truth defence' by Network Ten and Wilkinson has put a spotlight on the incident at Parliament House and the events leading up to it.

    " Mr Lehrmann’s statement of claim submitted both Ms Wilkinson and Network Ten were “recklessly indifferent to the truth or falsity of the imputations carried by the matters complained of in publishing the assertions and allegations”.
    “The conduct of the [respondents] in presenting the publication of the matters complained of in an over-sensationalised manner indicating intent to injure [Mr Lehrmann’s reputation],” it stated.
    Network Ten and Lisa Wilkinson’s defence documents outline that while they did publish a story about Ms Higgins’ allegations, if they’re found liable to Mr Lehrmann for damages, “which is denied”, they’ll be relying on the truth defence. "

    Network 10 certainly did a better job than police, of investigating the circumstances and events leading up to the allegation of rape and if this information had been put forward in the criminal trial, the result would likely have been very different.

    I still reckon that juror deliberately left stuff to be found in the room so the judge would have to can the trial.

    Your correct GM...the judge has been very transparent in this case. On the evidence provided during this case it certainly shows that Lisa and Ch 10 had serious concerns themselves regarding Brittanys interview but marched on regardless. Guess its going to be answered in 2024 if the court believes he's been defamed or not.

    He's also on to the Youtuber who continued to breach the courts orders to not livestream the proceedings. Glenn Logan has been ordered to appear in person before the Federal Court on 13/2/2024 to explain his actions.

    So Justice Lee has ran out of patience and heard evidence regarding contempt of court in the absence of the defendant Glenn Logan.
    Mr Logan ran you tube videos of the defamation trial contrary to many warnings from the judge.His lawyer submitted medical evidence that while Logan, who is “not intellectually disabled but of low intelligence”, was prepared to apologise to the court for his error.

    “Mr Logan admits the contempt,” he said.

    “It occurred through a lack of attention, little knowledge of the consequences and borne out of new technology and Mr Logan’s mental history has clearly contributed to the offence and lack of understanding.”
    On Tuesday, Mr Logan failed to appear as instructed at 9.30am but his lawyer indicated he was on the way and had caught the first plane that day from Melbourne.
    Justice Lee then indicated he intended to refer the matter for contempt proceedings.

    So Lisa Wilkinson has won her battle with Ch 10 to cover her legal expenses over her defence of defamation brought against her by Bruce Lehrman. Some very interesting things came out during these proceedings including the fact that finally ch 10 legal admitted , reluctantly, that they read and approved the speech at the logies and when it resulted in the trial being derailed they withdrew and never accepted that everyone from their lawyers to their Ceo read and approved the speech prior.
    The judge was scathing of Lisa regardless of the outcome "Justice Lee said earlier in the day that a journalist with more than four decades of experience should have been able to see the potential risks of making a speech just days before a criminal trial.

    Mr Lehrmann alleges the imputation of his guilt was exacerbated by Ms Wilkinson’s speech at the Logies, in which she praised Ms Higgins for her “unwavering courage”.

    On Wednesday, Justice Lee said the risks of making the speech ought to have been obvious to a “cadet journalist”.
